Discipline Procedures (Appeals procedure below)

DISCIPLINARY PROCEDURES

1. In the event of any player or players being reported for bad behaviour, a written report shall be submitted to Peter Robinson by the "Complainant" so that it is received by the Chairman of the Disciplinary Committee by the Tuesday following the incident. The report must contain all factual information in relation to the incident. The report shall also confirm that the player or players reported have been advised that they have been reported and further, the report shall confirm that the two captains on the day in question have also been told that a player or players have been reported. The report shall contain any other information considered relevant by the "Complainant".

2. If the Chairman of the Disciplinary Committee is of the opinion that the conduct described in the "Complainants" report is so serious that sanctions other than those contained within the Voluntary Code of Conduct should be considered, the Chairman shall forthwith write to the two captains on the day requesting a written report with regard to the incident. Such a report must be sent to Peter Robinson so that it is received by him no later than the Monday following his receipt of the "Complainants" report.

3. The Disciplinary Committee shall sit to consider the reports of the "Complainants" and the captains no later than fourteen days after the incident. The Committee shall have the power to pass the following sanctions. A player or players may be suspended from playing in the Kent Cricket League for any number of matches considered appropriate by the Disciplinary Committee. There shall be no limit to this power. Further, the Disciplinary Committee shall have the power to impose a fine, to the maximum of £100 on any Club who has a player suspended by the Disciplinary Committee.

4. Any suspension imposed by the Disciplinary Committee suspension shall be over and above the suspension already in place by the virtue of the Voluntary Code of Conduct.

5. When a player is suspended by the Disciplinary Committee the Disciplinary Committee shall notify the player and his Club within 14 days of the date of the Disciplinary Committee Meeting.

6. When the Disciplinary Committee impose a fine upon a Club, the Chairman of that Club shall be notified of the fine within 14 days of the date of the Disciplinary Committee Meeting.

7. No Club shall have the right of appeal against any fine imposed by the Disciplinary Committee.

8. A player suspended by the Disciplinary Committee shall have no right of appeal against such suspension, save only as mentioned in paragraph below.

9. If a player is suspended for a period greater than six matches, not including any suspension imposed under the terms of the Voluntary Code of Conduct, that player or the Club, shall have a right of appeal against the suspension but only insofar as it relates to that part of the suspension which is greater than six matches, excluding any suspension imposed under the terms of the Voluntary Code of Conduct.

10. Any Appeal lodged pursuant to paragraph 9 shall only be an appeal against the length of the suspension.

NOTE

The "Complainant" shall be an umpire officiating in the relevant game or the Chairman of one of the Clubs involved in the relevant game or in the absence of the Chairman an Officer of that Club, who shall not be a Captain of any side within the Club, nor a player in the relevant game.

APPEALS FOR DISCIPLINARY PROCEDURES

1. If any player suspended by the Disciplinary Committee or the Club with any player suspended by the Disciplinary Committee has a right of appeal against suspension the following procedure shall be adopted.

2. Within seven days of the receipt of the letter notifying the details of the suspension the player or his Club shall lodge a letter of appeal together with a fee of £50. The letter and fee shall be sent to Peter Robinson within the time period stated above. The Disciplinary Committee reserve the right to reject any such appeal that is not lodged with Peter Robinson within the stated period of time.

3. Upon receipt of a letter of appeal the Chairman of the Disciplinary Committee shall cause the Appeal Committee to meet within 21 days of the date the appeal letter was received by the Chairman of the Disciplinary Committee.

4. The Appeal Committee shall have no power to increase the suspension imposed by the Disciplinary Committee. The Appeal Committee shall only have the power to either refuse the appeal or lessen the period of suspension. The Appeal Committee has no power to interfere with any automatic suspension by virtue of the Voluntary Code of Conduct. In the event that an appeal is successful, either wholly or in part, the Appeal Committee shall have the discretion to refund some or all of the appeal fee of £50. Any decision in relation to this matter made by the Appeal Committee shall not be the subject of any further appeal.

5. The player who is the subject of the appeal may attend the Appeal Committee in person and he shall be allowed to address the Appeal Committee in person by way of mitigation. If the appeal is lodge by the Club then the Club shall have the right to send a Club Official to address the Appeal Committee by way of mitigation. Any such mitigation presented to the Appeal Committee shall only address the issue as to why the suspension should have been for a shorter period of time.

6. The Appeal Committee shall forward its findings in writing to the Club and to the player within seven days of the date of the hearing.

7. The Appeal Committee shall be constituted in accordance with the relevant paragraphs of the Constitution of the Kent Cricket League.
